Analysis of the Resolution Process for Fiduciary Guarantee Embezzlement in the Criminal Investigation Unit of Payakumbuh Police

One of the criminal acts related to assets is embezzlement, which often occurs within financial or banking institutions. The increasing public reliance on financial institutions for business and trade activities indicates a growing demand for goods and services. This research aims to analyze the resolution process for fiduciary guarantee embezzlement and identify the challenges and efforts undertaken by the Criminal Investigation Unit of the Payakumbuh Police. Employing empirical research methods, including interviews and case studies, analyzed through a descriptive-qualitative approach, this study utilizes primary data. The findings indicate that in 2023, out of 22 reported cases of fiduciary guarantee embezzlement, only 4 were resolved. The resolution process prioritized out-of-court settlements. However, challenges include the reluctance of fiduciary givers to respond to police summons. Efforts have been made to locate the fiduciary givers and the associated guaranteed objects.
