RESTORATION OF SOCIAL JUSTICE AS A GOAL OF CRIMINAL PUNISHMENT

The article is devoted to the problem of the doctrinal interpretation of the restoration of social justice as the purpose of punishment. The punishment inflicted by the guilty is considered as a social conflict that can be resolved through the application of punishment that meets the principle of justice. Otherwise, especially if the court imposes punishment without taking into account the mentioned principle, the conflict can be resolved through lynching or folk tradition. The restoration of social justice is the resolution of a social conflict caused by the unlawful actions of the perpetrator.
