Постановка проблеми. В умовах перевантаженості судів, тривалості судових процедур і зниження довіри до традиційного правосуддя зростає потреба в ефективних альтернативних способах вирішення спорів, серед яких важливе місце посідає медіація. Попри наявність позитивного зарубіжного досвіду, у науковій доктрині та правозастосовній практиці недостатньо дослідженими залишаються питання поєднання нотаріальної діяльності з медіаційними процедурами, межі участі нотаріуса як медіатора та гарантії його неупередженості. Мета. З’ясування сутності та місця медіації у сучасній системі альтернативного правосуддя, аналіз національного та зарубіжного досвіду її правового регулювання, визначення особливостей і меж поєднання нотаріальної діяльності з виконанням функцій медіатора. Методи. Дослідження базується на поєднанні загальнонаукових і спеціально-юридичних методів. Історико-правовий метод використано для аналізу становлення інституту медіації та трансформації професійного статусу нотаріуса. Формально-юридичний метод застосовано для опрацювання положень Закону України "Про медіацію" та Закону України "Про нотаріат" у частині регулювання участі нотаріуса в медіаційних процедурах. Порівняльно-правовий метод дозволив зіставити український підхід із практикою Франції, Бразилії та Індії. Системні і функціональні методи забезпечили визначення місця медіації у структурі сучасного правопорядку та окреслення меж поєднання нотаріальних і медіаційних функцій з урахуванням принципу нейтральності. Результати. З’ясовано зміст законодавчих новацій щодо розширення професійно-правового статусу нотаріуса у зв’язку з прийняттям Закону України "Про медіацію" та внесенням змін до Закону України "Про нотаріат", зокрема в частині визначення ролі Нотаріальної палати України у професійній підготовці нотаріусів у сфері медіації. Проаналізовано концептуальну напругу між обов’язком нотаріуса надавати правові роз’яснення й попереджати про правові наслідки нотаріальних дій та забороною медіатора консультувати сторони щодо суті спору. Визначено спільні для України, Франції, Бразилії та Індії тенденції до посилення ролі медіації як інструменту зниження конфліктності та розвантаження судової системи за умови нормативного закріплення принципів добровільності, конфіденційності, нейтральності й процедурної впорядкованості. Доведено, що найбільш інтенсивна інтеграція медіації у судову сферу простежується у Франції та Індії, тоді як у Бразилії ключовим механізмом виступає процесуальна імперативність початкової стадії примирення і медіації. Висновки. Встановлено наявність істотних функціональних і принципових відмінностей між нотаріальною діяльністю та медіацією, що ускладнює їх практичне поєднання без ризику порушення базових засад відповідних інститутів. Підкреслено, що національна модель вирізняється нормативним визнанням суміщення нотаріальної діяльності з медіаційною, тоді як у досліджуваних зарубіжних правопорядках нотаріуси залучаються до медіації на загальних підставах без надання їм спеціального "нотаріального" медіаційного статусу. Problem statement. In the context of overloaded courts, lengthy judicial procedures, and declining public trust in traditional justice, there is a growing need for effective alternative dispute resolution methods, among which mediation occupies an important place. Despite positive foreign experience, legal doctrine and law-enforcement practice still insufficiently address the issues of combining notarial activity with mediation procedures, the limits of a notary’s participation as a mediator, and guarantees of the notary-mediator’s impartiality. Purpose. Clarification of the essence and place of mediation in the modern system of alternative dispute resolution, analysis of national and foreign experience in its legal regulation, and determination of the specific features and limits of combining notarial activity with the performance of mediator functions. Methods. The study is based on a combination of general scientific and special legal methods. The historical-legal method was used to analyze the development of the institution of mediation and the transformation of the professional status of the notary. The formal-legal method was applied to examine the provisions of the Law of Ukraine "On Mediation" and the Law of Ukraine "On Notariat" regarding the regulation of a notary’s participation in mediation procedures. The comparative legal method made it possible to compare the Ukrainian approach with the practice of France, Brazil, and India. The systemic and functional methods ensured the determination of mediation’s place within the structure of the modern legal order and the outlining of the limits for combining notarial and mediation functions, taking into account the principle of neutrality. Results. The content of legislative innovations aimed at expanding the professional and legal status of notaries has been clarified in connection with the adoption of the Law of Ukraine “On Mediation” and the amendments to the Law of Ukraine “On Notaries”, in particular, about defining the role of the Notarial Chamber of Ukraine in the professional training of notaries in the field of mediation. The conceptual tension between the notary’s duty to provide legal explanations and to warn parties about the legal consequences of notarial acts, on the one hand, and the prohibition imposed on mediators to advise the parties on the merits of the dispute, on the other hand, has been analysed. Common trends for Ukraine, France, Brazil and India towards strengthening the role of mediation as an instrument for reducing conflict and alleviating the burden on the judicial system have been identified, provided that the principles of voluntariness, confidentiality, neutrality and procedural orderliness are закреплені by law. It is demonstrated that the most intensive integration of mediation into the judicial sphere is observed in France and India, whereas in Brazil the key mechanism is the procedural mandatory nature of the initial conciliation–mediation stage. Conclusions. Significant functional and principled differences between notarial activity and mediation are established, which complicate their practical combination without the risk of violating the fundamental principles of the respective institutions. It is emphasized that the Ukrainian model is distinguished by the regulatory recognition of combining notarial activity with mediation, whereas in the foreign legal orders examined notaries are involved in mediation on a general basis, without being granted a special “notarial” mediation status.
