The problem of applying the criminal procedure by analogy juris in disciplinary proceedings arising from members of the civil service corps

<ns3:p>Many acts establishing disciplinary responsibility contain provisions referring to the appropriate application of the Code of Criminal Procedure in these proceedings. This is axiologically justified by the affinity between disciplinary proceedings and criminal proceedings in the strict sense. However, the legislator did not provide for such a reference in the Civil Service Act. A more in-depth analysis of the disciplinary procedure under this legal regime allows for the formulation of the thesis that without resorting to the provisions of the Code of Criminal Procedure, conducting a disciplinary trial of a civil service member appears impossible. This issue prompts a broader perspective on the application of analogy in penal proceedings.</ns3:p>
