Disciplinary responsibility in the literature of the Second Polish Republic – selected aspects

<ns3:p>The author has attempted to present not only the legal regulations in force in the country between 1918 and 1939, but also the views of legal scholarship regarding disciplinary liability as a legal institution establishing a specific method of holding selected professional groups employed in the state apparatus accountable for their members' violations not only of specific professional duties but also for reprehensible conduct that brings discredit upon the reputation of both the profession and the state. Referring to the first issue, the Author pointed to the criteria for such a subjective approach to these regulations, which accepted as a criterion for penalization those violations of professional duties and behaviors that not only disrupted the proper functioning of specific state institutions, but also brought discredit not only to the good name of the profession performed by the perpetrator, but also to the state whose representatives they represented in the performance of their professional duties. Discussing the views of the doctrine in relation to disciplinary liability, the Author stated that it was the doctrine that formulated the basic principles of this institution, in which a special role was played by the 19th-century lawyer August Heylman, while later lawyers interpreted the law in force in this respect.</ns3:p>
