The Jurisdictional Void: Federal Immunity, Evidence Control, and the Collapse of Constitutional Remedy

A jurisdictional void exists when immunity doctrines, standing requirements, and enforcement barriers combine such that constitutional injury cannot be remedied in any forum. This condition is proven when courts recognize violations and order remedies, yet the executive branch refuses compliance and existing doctrine provides no mechanism to compel enforcement. This Article documents the jurisdictional void as Phase 2 of authoritarian consolidation. Building on the framework of administrative force and reality inversion established in The Architecture of Modern Sedition, it traces the collapse of constitutional remedy across five doctrinal domains: federal officer civil liability, sovereign immunity, state prosecution of federal actors, prosecutorial independence, and judicial enforcement authority. It demonstrates how the convergence of restricted Bivens remedies, qualified immunity, sovereign immunity, and federal preemption of state investigative authority produces a structural condition in which documented constitutional violations encounter no enforceable remedy in any available forum.
