Regulatory Transplants Are Failing Africa Inference Audits + Low-Bandwidth Contestability as the Fix — A Practical Roadmap This report shows why major AI governance frameworks imported from Brussels, Washington, and Geneva (EU AI Act, NIST AI RMF, ITU standards) are failing across most of Africa. They were designed for gigabit broadband, mature enforcement institutions, and fintech sectors that can absorb compliance costs in the hundreds of thousands of dollars — conditions that do not exist in the median African regulatory context. Instead of protecting citizens, these “regulatory transplants” create compliance theatre that concentrates power in foreign vendors, delegitimises local institutions, and deepens the global inference divide — the structural gap between models trained on continuous high-bandwidth sessions and real African users experiencing bursty, low-bandwidth connections (routinely 1–2 Mbps at peak hours even when nominal medians reach 36 Mbps in Nigeria). Key insights The inference divide is infrastructure-encoded: models misread degraded connectivity as user risk. Compliance costs (100K–300K USD per high-risk system) structurally exceed median African fintech revenues (~85K–110K USD). Public data exhaustion is accelerating dependency on sensitive foreign datasets. Three failure modes are already operating: inference without recourse, chokepoint convergence, and crisis blindness. The proposed solution rests on three contextual principles: Contestability before compliance — minimum viable mechanisms (SMS/USSD) that let citizens challenge AI decisions. Inference audits over data audits — examining what the system actually concludes, not just what data it collected. Layered sovereignty — modular governance that works at national, regional, and community levels simultaneously. The report includes three immediately deployable pilot blueprints (Kenya credit-scoring inference audit, Nigeria SMS/USSD contestability system, and South Africa layered sovereignty framework) that require no new primary legislation and function under real 2026 broadband conditions.
