Institutional Signaling and Legal Risk in Mexico's USMCA Review: The Article 127 Reform and the Erosion of Institutional Continuity

This paper analyzes the institutional signaling effects derived from Mexico’s constitutional reform to Article 127 within the context of the 2026 USMCA review. It argues that the retroactive adjustment of consolidated labor and pension conditions operates not only as a fiscal policy mechanism but as a structural signal affecting institutional continuity and legal certainty. The analysis situates this development within international investment law standards—particularly Fair and Equitable Treatment (FET) and the doctrine of legitimate expectations—highlighting the indirect transmission of risk through capital allocation decisions and country risk perception. The paper concludes that while fiscal savings are immediate and measurable, the associated institutional cost materializes through increased uncertainty, potentially affecting long-term economic integration and investment flows. This dynamic reframes the reform from a fiscal adjustment into a signal affecting the baseline assumption upon which contractual commitments are evaluated.This paper does not evaluate the reform from a political or distributive perspective, but strictly from its institutional signaling implications within international economic integration.
