In their work, the authors come to the conclusion that the practice of calculating the limitation period for claims for compensation for damage caused by a crime from the moment the court verdict comes into legal force is erroneous. The expiration of the limitation period is a civil law instrument of protection, the application of which cannot be made dependent on the implementation of the criminal procedural mechanism for investigating a criminal case and proving guilt. The beginning of the limitation period should be associated with the subjective moment of the victim's knowledge of the fact of the violation and the violator in relation to the specific factual circumstances of the emergence of the protective legal relationship.
